Montana Code Annotated · § 80-18-111 — Affirmative defense for possession or cultivation of marijuana

It is an affirmative defense to a prosecution for the possession or cultivation of marijuana that

the defendant was growing or processing hemp in compliance with this part or a tribal plan approved by the United States department of agriculture.
